Medical Marijuana - Last year, Arizona voters passed Proposition 203 (now codified as A.R.S. 36-2801 et seq.), the Arizona Medical Marijuana Act.  There is a lot of confusion surrounding the impact of the law on landlords due to a conflict between state and federal law. Our firm believes that the use of medical marijuana should be prohibited on a rental property as marijuana continues to be a Class 1 drug under the federal Controlled Substances Act.  Regardless of whether a landlord allows or limits the use of marijuana on the rental property, they would be wise to adopt a written policy informing tenants of their rights.  Feel free to contact our office to learn more about medical marijauna's impact on landlords.  Click the links for a sample addendum prohibiting marijuana or for an addendum limiting the use of marijauna.   

Bed Bugs - Effectively July 20, 2011, property owners and managers renting residential multi-family dwelling units, will be required to provide their tenants with information sheets regarding bed bugs, pursuant to the new A.R.S. 33-1319. All landlrods would be wise to also adopt and use a bed bug addendum identifying the rights and obligations of the landlord and tenant in the event bed bugs are present in the rental property.  Contact our office to get the necessary information sheet and addendum to make sure you are compliant with the law and to protect your property.
